1. Introduction

These Terms of Service (“Terms”) govern your use of Kikloper (the “Service”), operated by Webicha LLC (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms.

Webicha LLC is a limited liability company registered in New Mexico, United States.

2. Eligibility

To use the Service, you must:

  • Be at least 13 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activities that occur under your account. You must notify us immediately at [email protected] if you suspect unauthorized access to your account.

3.3 One Account Per User

Each user may maintain only one account. We reserve the right to terminate duplicate accounts.

4. Service Description

Kikloper provides website monitoring services, including:

  • Uptime monitoring with HTTP checks
  • SSL certificate expiry tracking (automatic detection)
  • Domain registration expiry tracking (automatic detection)
  • Hosting expiry tracking (manual entry)
  • Alert notifications (email and push)
  • Shareable status report pages for clients

5. Subscription Plans and Billing

5.1 Plans

We offer the following subscription plans:

Annual billing is available at a discounted rate.

5.2 Free Trial

New users receive a 14-day free trial with access to all features and up to 5 sites. No credit card is required. After the trial ends, you may choose to upgrade to a paid plan or continue with the Free plan.

5.3 Billing

  • Paid subscriptions are billed in advance on a monthly or annual basis
  • All fees are in US Dollars (USD)
  • Payments are processed securely through Stripe
  • You authorize us to charge your payment method for all fees due

5.4 Price Changes

We may change our prices with 30 days’ notice. Price changes will take effect at the start of your next billing cycle.

5.5 Taxes

Prices do not include applicable taxes. You are responsible for any taxes associated with your subscription.

6. Refunds and Cancellation

6.1 Refund Policy

We offer a 14-day money-back guarantee on all paid subscriptions. If you are not satisfied with the Service, contact us within 14 days of your payment for a full refund. No questions asked.

After the 14-day period, refunds are provided at our sole discretion.

6.2 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your subscription remains active until the end of the current billing period
  • You will not be charged for subsequent periods
  • Your data will be retained for 30 days after expiration, then permanently deleted

6.3 Downgrade to Free

When you cancel a paid subscription or your trial ends, you may continue using the Free plan with reduced features and limits.

7. Acceptable Use

You agree NOT to use the Service to:

  • Monitor websites you do not own or have permission to monitor
  • Engage in any illegal activity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any systems
  • Use automated means to access the Service beyond normal API usage
  • Transmit malware, viruses, or harmful code
  • Harass, abuse, or harm others
  • Impersonate any person or entity
  • Violate any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these terms.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its design, features, code, and content, is owned by Webicha LLC and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

8.2 Your Data

You retain ownership of all data you submit to the Service. By using the Service, you grant us a limited license to use your data solely to provide and improve the Service.

8.3 Feedback

If you provide feedback or suggestions, we may use them without obligation to compensate you.

9. Third-Party Services

The Service integrates with third-party services including Supabase, Vercel, Resend, and Stripe. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions of third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF MONITORING DATA

We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • Monitoring data will be 100% accurate
  • The Service will meet all your requirements
  • Any errors will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for any loss of data, profits, or business opportunities

This limitation applies regardless of the theory of liability (contract, tort, or otherwise).

12. Indemnification

You agree to indemnify and hold harmless Webicha LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party

13. Service Availability

We strive to maintain high availability but do not guarantee specific uptime. We may temporarily suspend the Service for:

  • Scheduled maintenance (with advance notice when possible)
  • Emergency repairs
  • Circumstances beyond our reasonable control

14. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time. For significant changes, we will provide reasonable notice.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the “Last Updated” date
  • Sending an email notification

Your continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through:

  1. Good faith negotiation
  2. If negotiation fails, binding arbitration in New Mexico under the rules of the American Arbitration Association

You waive any right to participate in class action lawsuits against us.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Webicha LLC regarding the Service.
